Awake In Wellness

By enrolling in and participating in yoga classes, guided meditations, wellness sessions and/or readings offered by Awake In Wellness or Ashley Nguyen, you agree to abide by the terms and conditions outlined herein. You hereby agree to release and discharge from liability arising from negligence Awake In Wellness or Ashley Nguyen and its owners, employees, volunteers, and all other persons or entities acting for them (hereinafter collectively referred to as “Releases”), on behalf of yourself and your children, parents, heirs, assigns, personal representatives and estate, and also agree to the terms outlined as follows:

1. I (hereinafter “I” or ‘applicant”) have been examined by a licensed Physician within the past six months and have been found by such physician to be in good health and full able to perform all Yoga exercises which I am to learn and perform during my enrollment with Awake In Wellness or Ashley Nguyen.

2. I will faithfully follow all instructions given to me by Releases as to when, and how to perform and not to perform Yoga Exercises. I understand the practice of Yoga and group exercise activities may expose me to risk of personal injury, disease, or death and I knowingly and willingly assume such risk.

3. In the event that I am pregnant, I will not attend a yoga class until I have discussed the potential risks to me or my unborn child/fetus with a medical professional. I agree that I will follow my medical professional’s recommendations and on behalf of myself, my heirs, spouse or other interested party hold harmless Awake In Wellness or Ashley Nguyen for any possible injury to myself or my unborn child/fetus.

4. Awake In Wellness or Ashley Nguyen is a birth chart reader and offers insights based on astrological interpretations. It's essential to understand that astrology and human design is a tool for self-reflection and exploration, not a determinant of fate or a substitute for professional advice.

   1. By receiving a reading from Awake In Wellness or Ashley Nguyen, you acknowledge that:

      1. Awake In Wellness or Ashley Nguyen cannot predict or dictate how you should live your life based on your birth chart.

      2. Any information provided in the reading is for entertainment and self-awareness purposes only.

      3. You are solely responsible for the decisions you make and the actions you take in your life.

      4. Awake In Wellness or Ashley Nguyen is not liable or responsible for any outcomes or consequences resulting from your interpretation or use of the information provided in the reading.

5. Please consider seeking professional advice or counseling for specific matters requiring medical, legal, financial, or psychological assistance. Remember, your birth chart and human design is a tool for self-discovery and empowerment, but ultimately, you are responsible for your own choices.

6. If I am under 18 years of age, I warrant that I have disclosed my age to Releases and in addition to my signature, have provided the signature of my parent or legal custodian or guardian below.

7. Use of the methods, techniques, advice, or information provided by Awake In Wellness or Ashley Nguyen, its Releases, programs, materials, information, services, websites or views are at my own choice and I understand the risk associated with them.

8. In the event that I file a lawsuit, I agree to do so solely in the state of Colorado and I further agree that substantive law of the state shall apply.

9. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portion shall remain in full force and effect.

Cancellation Policy

2.1. Cancellations made at least 24 hours before the scheduled class will be eligible for a full refund.

2.2. Cancellations made within 24 hours of the scheduled class will not be eligible for a full refund. No exceptions will be made.

Booking and Attendance

3.1. All classes must be booked in advance on the Awake In Wellness website.

3.2. It is the responsibility of the student to arrive on time for the scheduled class.

3.3. Late arrivals may result in the student being denied entry to the class, with no refund issued.

Liability Waiver

4.1. By participating in yoga classes offered by Awake In Wellness or Ashley Nguyen, you acknowledge and understand that there are inherent risks associated with physical activities.

4.2. Awake In Wellness or Ashley Nguyen, its instructors, and staff are not liable for any injuries, accidents, or other incidents that may occur during or as a result of participating in yoga classes.

4.3. It is the responsibility of the student to inform the instructor of any pre-existing medical conditions or injuries that may affect their ability to participate in the class.

Class Changes and Cancellations

5.1. Awake In Wellness or Ashley Nguyen reserves the right to change the schedule, instructor, or cancel classes without prior notice.

5.2. In the event of a class cancellation by Awake In Wellness or Ashley Nguyen, a full refund or credit will be issued to the affected students.

Code of Conduct

6.1. Students are expected to conduct themselves in a respectful and considerate manner during classes.

6.2. Awake In Wellness or Ashley Nguyen reserves the right to remove any student from a class if their behavior is disruptive or violates the studio's code of conduct.

Privacy Policy

7.1. Awake In Wellness or Ashley Nguyen respects the privacy of its students and will not disclose personal information to third parties without consent.

7.2. By enrolling in classes, students agree to receive communications from Awake In Wellness or Ashley Nguyen regarding schedule changes, promotions, and other relevant information.

Governing Law

8.1. These terms and conditions are governed by the laws of Colorado.

8.2. Any disputes arising from or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts in Colorado

I agree that if I am hurt or my property is damaged during my participation in this activity, then I may be found by court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claims of negligence.

By booking a yoga class or reading with Awake In Wellness or Ashley Nguyen or registering for a class or event, I agree to be bound by the terms listed above.

By enrolling in and participating in classes and readings offered by Awake In Wellness or Ashley Nguyen, you acknowledge that you have read, understood, and agreed to these terms and conditions.
